 All you need to Know Before Buying a Property in Andalucia,Malaga, Benalmadena

 

In this Section we explain everything you need to know before purchasing a property, be it a Plot, Apartment, Townhouse or Villa for Sale in Benalmadena or Andalucia.  Here we cover the following:

Planning your Purchase Costs-

Here we give you an in depth breakdown on the costs you should expect to pay when purchasing an apartment, villa or house for sale in Benalmadena. We will explain this in detail to include mortgage costs also.

Before purchasing here, it would probably be useful for you to know the costs in purchasing a property . The following breakdown is based on the purchase of a resale property as the purchase tax applicable is referred to ITP and is not IVA (vat) as when purchasing a brand new property.   Firstly in relation to the mortgage,  the banks are really quite difficult.   They use to give non-residents a mortgage of 70%,  nowadays I believe they prefer to lend on  the 60% level.

Also to note, at the time of this publication the ITP purchase tax rates (applicable to resale properties) are as follows:

NOTE:BRAND new properties have IVA (VAT) applicable not ITP therefore rate at time of publication is 4% where this increases to 10% in 2013.

If we take for example  purchase of a property at 200.000€.

Lets calculate the purchase costs first.

Purchase tax = 7% = 14.000€
Notary & Land Registry = 1.700€ aprox
Lawyers Fees = 2.360€ aprox
These Purchase costs = 18.060€

Mortgage Costs! – Consider this too

The bank will lend according to the purchase price / valuation, sometimes it may be the lower of these figures.  Therefore, assuming the the valuation reaches a minimum of 200.000€, the bank will lend 60% of this, being 120.000€.  They will normally charge an opening commission (up to 1%) and also have Notary /land registry fees associated with the mortgage deed which the bank should pay , as well as gestoria (admin charge)  Therefore the costs of the mortgage will be gestoria fee plus opening commission if any.

So the Total Purchase Costs with a mortgage based on Property of 200.000€ may be around 18.060€ plus gestoria fee + opening commission if any.
Purchase Price =            200.000€
Mortgage         =            120.000€
Pending =                     80.000€
Plus Costs in Purchase = 18.060€

Therefore funds needed will be 80.000€ + 18.060€ = 98,060€ +Gestoria fee (aprox 500€) + opening commision (500€?)
Please note, the figures above would need to be confirmed via your bank of choice and lawyer.  There may be banks that offer a higher percentage but best to assume the lower rate.

In addition to the above the banks will request proof of employment/salary , bank statements etc to assess the risk in lending.

NIE Application

It is now obligatory to have an NIE (Numero de Identidad Extranjero) when purchasing a property in Andalucia.  For EU citizens,  the application can be done very easily by a visit to the corresponding National Police Station (Comisaria). You will need a completed NIE application form , the corresponding completed fee payment form (which need to be collected from the police station before the application and the aprox fee of 16€ paid at local bank). On the day of application you may need to visit the Police station very early in the morning on the day of application in order to acquire a number for a place in the queue!  Once you return for the application with completed NIE form (1 original & 1 copy), stamped fee form with proof of payment, & good quality copy of passport,the application is processed fairly quickly and your new NIE number should be return to collect in 3-4 working days.

With this NIE number you can now purchase a property, a car and open a bank account.

Which Area?

We describe the different areas in Benalmadena and what you will find in each of these in relation to activities, facilties and urbanisation of Villas and apartments which you may find where there are attractive villas and apartments for sale.

Benalmadena can be divided into three main areas, these are as follows:

  • Benalmadena Pueblo
  • Arroyo de la Miel
  • Benalmadena Costa

Benalmadena Pueblo

The Pueblo is ideal place for those who like a real community feel which is typical of an Andalucian village. The centre of the pueblo is really composed of village townhouses with little parking, no terraces and no community pools.  Most of the urbanisations with parking, pool etc are located a little further out from the centre but apartments complexes which may offer good apartments for sale will include, Balcones de Benalmadena, Pueblo Jacaranda or townhouses for sale could be found in Las Moriscas (mainly 3 bed townhouses) or Benalvista (2 bed townhouses).  All these complexes offer Community pools and gardens and some parking, they are in my opinion the best located complexes for a holiday home closest to Benalmadena Pueblo.  If you are however looking for a Villa for sale in Benalmadena Pueblo then you may fing the following Urbanisations close to Benalmadena Pueblo: Rancho Domingo, La Vista, Casablanca and of course the Pueblo itself.  The area of La Capellania and El Higueron are sometimes categorised by some agents as Benalmadena Pueblo but are really about a 25 minute walk away.  The villas for sale in either of these Urbanisation tend to be fairly from the 80’s onwards but there are quite a number that were recently built.

Arroyo de la Miel

This area is below and East of Benalmadena Pueblo.  It can really be regarded at the “Town Centre” of Benalmadena with its high streets and good sense of residence and shopping activity ALL YEAR round.  There is also a useful Train station on the main high street.  The trains tend to run every half hour and stops include Malaga Centre , the Airport and Fuengirola amongst many aother stops in between. The downside of property hunting in Arroyo de la Miel is that the property here tends to be quite old and therefore many apartments located close to centre may not have community pools and/or be a bit dated. Nevertheless its a good place to live given that the beach is not that far and shops/restaurants galore in this immediate vicinty. If you are looking for a Villa for sale in Arroyo de la Miel…..Good luck!  there tend to be very few villas located close to Arroyo de la Miel Centre!  However, you may find the Urbanisations of Veracruz, Monte Alto and Santangelo good options for a Villa.

Benalmadena Costa

Benalmadena Costa is referred to generally by most as the whole coastline of Benalmadena.  However, when you see some properties described as Benalmadena Costa by some agencies it doesnt neccesarily mean that it is walking distance to the beach, so please take this with a pinch of salt!  I always like to give my clients a good description of Benalmadena Costa, dividng it into different areas.  The apartments for sale in Benalmadena Costa can vary in price dramatically depending on the area.  Here are the main areas of Benalmadena Costa:

Central Areas (Close to Amenities (walking distance) etc)

  • Puertomarina
  • Paloma Park
  • Palm Tree Avenue
  • Torrequebrada (lower)

Distant from Central Main Amenities (not practical walking distance)

  • Nueva Torrequebrada (lower)
  • Torremuelle
  • La Perla
  • Carvajal

Villas for Sale in Benalmadena Costa tend to be located closer to Puertomarina or in the the area directly above Palm tree avenue.  An exclusive area of luxury villas with some for sale in the area of Torrequebrada.  Other villas on sale can also be found in Torremuelle, La Perla and just above Carvajal in Torremar.

The Property (What to look for)

Once you find the property, be sure to visit at different times of the day, this way you will have more of an idea of noise levels at different parts of day as well as natural light levels.

Humidity levels and rain fall may be quite intense on some winter days, so make sure you use your sense of smell for damp and check behind furniture and around windows and ceilings for any signs of damp. Some of these problems are easily resolved or just superficial but if in doubt please seek the expertise of an Architect who could carry out a building survey for a few hundred euros.

Ask your lawyer to translate the description of the Nota Simple.  The Nota Simple is a document which can be ordered online by any profesional agent, lawyer or bank.  It provides a description of the property and its regsitered metres as well as details of owners and if there are any mortages, loans or embargos pending on the property.  By asking your lawyer to translate this document you will be able to easily ascertain if there are any anomalies with the description.

Be sure to ask for the community charges amd what they include, also the latest agm mintues and the regulations in the community.  Also, ask the proof of council rates known as IBI or IBIU.   This is particularly useful and provides an abundance of information on the property.  Your lawyer or agent will be able to determine the “fiscal value” of the property.  This value is of important significance because if it is greater than the purchase value, the tax authority will normally send you a bill for the ITP purchase tax on the difference plus interest!

If the property is realtively new (usually less than 10 years) then be sure to ask for a copy of the First Occupation License. This license confirms that the build complies with the requirements of the townhall and that the build is finalised as a legal building, ready for occupation.  Without this license, it is quite likely that there are legal issues with the property. Some of these issues may be quite petty but in some cases serious, please check with your lawyer.

Reservation Process

In order to take a property off market a reservation fee of between 3000€ to 6000€ is normally required.  This is known as the initial reservation and may be held by the agent, lawyer or vendor.  This form usually needs to be signed by all parties i.e buyer and vendor in order to form a proper binding contract.  Following this deposit , it is not unusual to have a further stage payment totalling 10% of the purchase price.  This is known as the private purchase contract or “contrato de arras”.  Under Spanish law if a buyer pulls out of a purchase following a mutually signed contract, he/she will lose their deposit unless of course there is a legal issue with the property.  If however the vendor pulls out then the buyer has the right to have his/her deposit returned and legally has the right to seek compensation to the same amount from the vendor. i.e the vendor may have to return twice the amount!

Completion at Notary

On this day, all parties are either present or legally represented at the Notary and the deed is signed by all parties for the tranaction of the property to take place.  If a mortgage is required or for that matter cancelled, separate deeds for acquisition of mortage (purchase) or cancellation (sale) of mortgage will also be signed by the appropriate party and their bank.  It is when these deeds are signed that the keys are normally handed over to the buyer and the buyer takes possesion of the property free of tenants.  The buyer will normally be required to pay notary fees and the land registry and will have a period of 30 days to pay ITP tax, plusvalia and 3 % capitals gains (if retained from vendor).

En esta sección se explica todo lo que necesita saber antes de comprar una propiedad, ya sea un terreno, apartamento, casa o Chalet en venta en Benalmádena o Andalucía. Aquí se describe lo siguiente:

Planificación de Costos-Compra

Aquí te damos un desglose en profundidad sobre los costos que usted debe esperar a pagar en la compra de un apartamento, villa o casa en venta en Benalmadena. Vamos a explicar esto en detalle para incluir los costos hipotecarios también.

Antes de comprar aquí, probablemente sería útil para que usted pueda conocer los costos en la compra de una propiedad. El desglose siguiente se basa en la compra de una vivienda de segunda mano como el impuesto de compra aplicable se refiere a ITP y no es IVA (IVA) en la compra de una nueva propiedad. En primer lugar, en relación a la hipoteca, los bancos son realmente muy difícil. Vamos a calcular los costos de compra de primera.

Compra impuestos = 7% = 14.000 €
Notario y Registro de la Propiedad = 1.700 € aprox
Abogados Honorarios = 2,360 € aprox
Estos costos de Compra = 18.060 €
Costes de la hipoteca! – Considere esto también

El banco prestará de acuerdo con el precio de compra / valoración, a veces puede ser la menor de estas cifras. Por lo tanto, suponiendo que la valoración de los alcances de un mínimo de 200.000 €, el banco presta el 60% de esta, siendo 120.000 €. Por lo general se cobra una comisión de apertura (hasta 1%) y también tienen notario / tierra tarifas de registro asociadas con la escritura de hipoteca (esto debrian pagarlo el banco) así como gestoría (cargo admin) Por lo tanto, los costos de la hipoteca será coste gestoria mas comisión de apertura.

Así que los costes totales de compra con una hipoteca sobre la base de la Propiedad de 200.000 € puede ser alrededor de 18.060 €
Precio de compra = 200.000 €
Hipoteca = 120.000 €
Pendiente = 80.000 €
Más gastos de Compra = 18.060 €

Por lo tanto, los fondos necesarios serán 80.000 € + 18.060 € = 102.560 € mas gestoria (aprox 500€) y mas comision de apertura (500€?)
Tenga en cuenta que las cifras anteriores se debe confirmar a través de su banco preferido y abogado. Puede haber bancos que ofrecen un mayor porcentaje mejor que asumir la tasa más baja.

Además de lo anterior, los bancos solicitarán una prueba de empleo / salario, extractos bancarios, etc para evaluar el riesgo del crédito.

Solicitud NIE

Ahora es obligatorio tener un NIE (Numero de Identidad Extranjero) en la compra de una propiedad en Andalucia. Para los ciudadanos de la UE, la aplicación se puede hacer muy fácilmente con una visita a la Estación de Policía Nacional correspondiente (Comisaría). Usted necesitará un formulario de solicitud completo NIE, el correspondiente formulario completo pago de la cuota (que deben ser recogidos de la estación de policía antes de la aplicación y la tarifa de 16 € aprox pagado al banco local). En el día de la solicitud puede que tenga que visitar la estación de policía muy temprano por la mañana en el día de la solicitud con el fin de adquirir un número para un lugar en la cola! Una vez que regrese a la solicitud con el formulario completado NIE (1 original y 1 copia), forma de pago sellada con el comprobante de pago, y copia de buena calidad de pasaporte, la solicitud se procesa con bastante rapidez y su número de NIE nuevo debe ser de vuelta para recoger en 3-4 días laborables.

Con este número NIE ahora se puede comprar una propiedad, un coche y abrir una cuenta bancaria.

 
Qué área?

Se describen las diferentes áreas en Benalmádena y lo que encontrará en cada una de ellas en relación con actividades, facilties y la urbanización de villas y apartamentos que usted puede encontrar donde hay bonitas villas y apartamentos para la venta.

 

Benalmádena se puede dividir en tres áreas principales, estos son como sigue:

    Benalmadena Pueblo
    Arroyo de la Miel
    Benalmadena Costa

 
Benalmadena Pueblo

El Pueblo es el lugar ideal para aquellos que prefieren una sensación de comunidad real, que es típica de un pueblo andaluz. El centro del pueblo está realmente compuesto de casas de pueblo con poco aparcamiento, terrazas y número de piscinas comunitarias. La mayor parte de las urbanizaciones con parking, piscina, etc se encuentran un poco más lejos del centro, pero complejos apartamentos que pueden ofrecer buenos apartamentos en venta incluirá, Balcones de Benalmádena Pueblo Jacaranda o casas en venta se puede encontrar en Las moriscas (principalmente tres casas cama) o Benalvista (2 casas cama). Todos estos complejos ofrecen piscinas comunitarias y jardines y un aparcamiento, son en mi opinión los mejores complejos ubicados en una casa de vacaciones más cerca de Benalmádena Pueblo. Si usted está buscando un embargo Villa en venta en Benalmadena Pueblo entonces puede fing las siguientes Urbanizaciones cerca de Benalmadena Pueblo: Rancho Domingo, La Vista, Casablanca y por supuesto el propio Pueblo. La zona de La Capellanía y El Higueron a veces se clasifican por algunos agentes como Benalmadena Pueblo, pero son realmente acerca de 25 minutos a pie. Las villas en venta en cualquiera de estos urbanización tienden a ser bastante a partir de los años 80, pero hay un buen número que se construyeron recientemente.
Arroyo de la Miel

Esta área se encuentra por debajo y al este de Benalmádena Pueblo. Lo que realmente puede ser considerado en el “centro de la ciudad” de Benalmádena, con sus calles principales y el sentido común de la residencia y de la actividad comercial durante todo el año. También hay una estación de tren de utilidad en la calle principal. Los trenes suelen pasan cada media hora y paradas incluyen el Centro de Málaga, el aeropuerto y entre Fuengirola aother muchas paradas en el medio. La desventaja de caza propiedad en Arroyo de la Miel es que la propiedad aquí tiende a ser bastante viejo y por lo tanto muchos apartamentos situados cerca del centro no tienen piscinas comunitarias y / o ser un poco anticuado. Sin embargo es un buen lugar para vivir, ya que la playa no está tan lejos y las tiendas / restaurantes en abundancia en este vicinty inmediata. Si usted está buscando un chalet en venta en Arroyo de la Miel ….. Buena suerte! suele haber muy pocas casas situadas cerca de Arroyo de la Miel Centre! Sin embargo, es posible que las urbanizaciones de Veracruz, Monte Alto y Santangelo opciones buenas para una villa.

 
Benalmadena Costa

Benalmádena Costa se conoce generalmente por la mayoría como toda la costa de Benalmádena. Sin embargo, al ver algunas de las propiedades descritas como Benalmádena Costa por algunas agencias no neccesarily significa que está a una corta distancia a pie de la playa, así que por favor tome esto con una pizca de sal! Siempre me gusta dar a mis clientes una buena descripción de Benalmádena Costa, dividng que en las diferentes áreas. Los apartamentos en venta en Benalmadena Costa pueden variar en precio dramáticamente dependiendo de la zona. Estas son las principales áreas de Benalmadena Costa:

Áreas de Centrales (Cerca de servicios (a pie), etc)

    Puertomarina
    Paloma Park
    Palm Tree Avenida
    Torrequebrada (inferior)

Distante de Servicios Centrales principales (no distancia a pie práctica)

    Nueva Torrequebrada (inferior)
    Torremuelle
    La Perla
    Carvajal

Villas en venta en Benalmádena Costa tienden a ubicarse más cerca de Puertomarina o en la zona directamente encima de la Palmera avenida. Una zona exclusiva de villas de lujo con un poco de venta en la zona de Torrequebrada. Otras villas en venta, también se puede encontrar en Torremuelle, La Perla y justo por encima de Carvajal en Torremar.

La Propiedad (Qué debe buscar)

Una vez que encuentre la propiedad, no deje de visitar en diferentes momentos del día, de esta manera usted tendrá más de una idea de los niveles de ruido en diferentes partes del día, así como niveles de luz natural.

Los niveles de humedad y la caída de lluvia puede ser muy intenso en algunos días de invierno, así que asegúrese de usar su sentido del olfato para comprobar la humedad y detrás de los muebles y alrededor de las ventanas y los techos para detectar cualquier signo de humedad. Algunos de estos problemas son fáciles de resolver o superficial, sino sólo en caso de duda por favor, buscar la experiencia de un arquitecto que podría llevar a cabo un estudio de capacidad para unos pocos cientos de euros.

Consulte con su abogado para traducir la descripción de la nota simple. La nota simple es un documento que se puede pedir en línea por cualquier agente profesional abogado, o un banco. Se proporciona una descripción de la propiedad y sus metros registrandose así como los detalles de los propietarios y si hay algún hipotecas, préstamos o embargos pendientes sobre la propiedad. Al pedirle a su abogado para traducir este documento usted podrá fácilmente comprobar si hay anomalías con la descripción.

Asegúrese de preguntar a la comunidad cargos amd lo que incluyen, además de las últimas mintuos agm y las normas de la comunidad. Además, pregúntele a la prueba de los tipos de consejo conocido como IBI o IBIU. Esto es particularmente útil y proporciona una abundancia de información sobre la propiedad. Su abogado o agente será capaz de determinar el “valor fiscal” de la propiedad. Este valor es de gran importancia ya que si es mayor que el valor de la compra, la autoridad fiscal general le enviará una factura por el impuesto de compra ITP de la diferencia más los intereses!

Si la propiedad es realtively nuevo (por lo general menos de 10 años), a continuación, asegúrese de pedir una copia de la Licencia de Primera Ocupación. Este formulario lo general tiene que ser firmado por todo el comprador y el vendedor, es decir las partes con el fin de formalizar un contrato vinculante adecuada. A raíz de este depósito, no es raro tener una etapa de pago por un total de más del 10% del precio de compra. Esto se conoce como el contrato privado de compraventa o “contrato de arras”. Según la legislación española si un comprador se retira de una compra después de un contrato firmado mutuamente, él / ella perderá su depósito a menos que, por supuesto, hay un problema legal con la propiedad. Sin embargo, si el vendedor se retira entonces el comprador tiene el derecho a que su / su depósito devuelto y legalmente tiene derecho a pedir una indemnización a la misma cantidad del proveedor. es decir, el vendedor puede tener que devolver el doble de la cantidad!
Finalización en la Notaría

En este día, todas las partes presentes o representados legalmente en la Notaría y la escritura se firma por todas las partes de la tranaction de la propiedad de tener lugar. Si la hipoteca se requiere o para el caso cancelado, actos separados para la adquisición de hipoteca (compra) o cancelación (venta) de hipoteca también será firmado por la persona apropiada y su banco. Es cuando estas obras están firmadas que las claves son normalmente entregados al comprador y el comprador toma posesión de la propiedad libre de inquilinos. El comprador normalmente tendrá que pagar gastos de notaría y registro de la tierra y tendrá un plazo de 30 días para pagar impuesto ITP, plusvalía y 3% de las ganancias capitales (si se retiene del proveedor).
