Preparing to Buy a Property in Benalmadena

Before purchasing a property in Benalmadena, it’s essential to be well-prepared for the process. Here’s what you need to do:

1. Obtain an N.I.E Number

Every foreign property purchaser (i.e., a person without a national ID number) must apply for an N.I.E (Número de Identidad Extranjero, or Foreign Identification Number) before buying a property. This also applies if you wish to buy a car or open a bank account. The NIE document identifies the purchaser for tax purposes and remains with them indefinitely.

To obtain the N.I.E, visit the National Police Station where you intend to purchase the property. First, make an appointment online at the relevant police station. Bring the completed form (click here for form), fill in the tax form (click for tax form), and pay the associated tax. The NIE document is usually available for collection one week after application.

2. Open a Bank Account

Once you have your NIE, the next step is to open a bank account. Visit a bank with your NIE document and passport. Once your bank account is active, you are ready to proceed with the property purchase. This account will be used for the property purchase and payment of all maintenance bills.

3. Consider Hiring a Lawyer

Instead of applying for the NIE and bank account yourself, you may hire a reputable property conveyancing lawyer to handle the process on your behalf. This involves providing the lawyer with a power of attorney to represent you. Power of attorney can be arranged in Benalmadena at a notary or at a consulate in your home country. This same lawyer will also assist with the due diligence in the purchase process.

About Purchase Costs - How much do you need to pay in Property Buying Costs and What Are They- All Explained

Purchase Costs When Buying a Property

The purchase costs are the following:

i) 7% ITP tax – this is the tax paid to the Andalucian government similar to stamp duty. This needs to be paid 30days within notary completion. This tax is based on the purchase price but be sure to check the tax value on the property. If the tax value is higher then you will need to pay ITP tax on the higher value, otherwise you may face a penalty in the future.

ii) Notary fees – The notary fees depend on value of the property and number of pages in the deed but generally for an apartment it would be around 1000euros.

iii) Land Registry fees – Once you purchase a property you will need to register the sale with the land registry, these fees for an apartment would be around 700euros.

iv) When purchasing a property you should use a lawyer to do the due diligence and pay all associated taxes and fees. Lawyers generally charge a fee of 1% plus IVA (vat which is currently 21%)

In general assume purchase costs in the region of 10% of the purchase price
